1. Scope
These terms apply to services by Rene Mazassita relating to 360° photography, virtual tours, media production, landing pages, websites, hosting and related digital services for holiday rentals, restaurants, hotels and other hosts on Mallorca.
Individual offers or written confirmations take precedence over these terms.
2. Provider, platform and contract
Rene Mazassita, Camí de Ca’n Jordi SN, 07650 Santanyí, Spain, email: hallo@mallorca360-tours.com, is the contractual contact for consulting, shooting, concept and project delivery.
The technical provision of tours, hosting, multilingual delivery, statistics and enquiry or booking functions may be provided through wolowo360.com.
Enquiries are non-binding. A contract is formed only once an offer is accepted or an order is confirmed in text form.
3. Scope of services
The provider offers in particular the following services:
- Creation of virtual 360° tours
- Real estate photography
- Panorama photography
- Drone footage (where legally permitted)
- Hosting of virtual tours
- Creation of websites for holiday properties
- Integration of booking systems
- Creation of interactive site maps
- Digital presentation solutions
- Technical support for delivered systems
3a. Specific scope
The specific scope of services follows exclusively from the respective offer or individual agreement.
4. Client cooperation
The client must provide access to the location, ensure it is ready for photography, supply required content and ensure that all provided material is lawful and does not infringe third-party rights.
5. Prices, acceptance and hosting
Prices and payment terms are defined in the offer or order confirmation. Ongoing hosting, maintenance or platform services are billed monthly or annually as agreed.
6. Usage rights
Unless otherwise agreed, the client receives a simple, non-transferable right of use for the created images, tours and other media for the agreed purpose.
All copyrights remain with the provider.
Any further distribution, reproduction, modification or commercial use beyond the agreed purpose requires the prior written consent of the provider.
6a. Hosting of 360° tours
Where hosting services are provided, the provider strives for the highest possible system availability.
However, permanent and uninterrupted availability cannot be guaranteed.
Maintenance work, technical faults, force majeure or third-party outages may cause temporary limitations.
7. Liability for client content
The client is responsible for all content provided by them.
The client ensures that transmitted texts, images, videos and other content do not infringe third-party rights.
The provider is entitled to refuse or remove unlawful content.
8. Consumers, withdrawal, liability and law
Where the client is a consumer and the contract is concluded at a distance or off premises, a statutory right of withdrawal may apply. Under EU consumer rules this period is generally 14 days for service contracts.
If the consumer expressly requests performance before the withdrawal period expires, compensation may be due for services already provided. Special rules may apply to digital content and digital services.
Mallorca360 Tours is not liable for expected bookings, revenue, rankings or platform results unless an express guarantee was given. To the extent legally permitted, Spanish law applies; consumers retain mandatory protections of their country of residence.
